Terms of Service

This is a translation of the German Terms of Service (Allgemeine Geschäftsbedingungen). In case of any discrepancy, the German version shall be the legally binding document.

§ 1 Scope of Application

These Terms of Service govern the use of the web application THEOSIS (hereinafter referred to as the "App"), operated by Theosis OÜ, Harju maakond, Tallinn, Kesklinna linnaosa, Estonia (hereinafter referred to as the "Provider").

By registering, you accept these Terms of Service as well as our Privacy Policy.

§ 2 Subject Matter of the Contract

THEOSIS is an Orthodox spiritual companion app that provides access to biblical texts, patristic commentaries, prayers, liturgical content, and community features. The Provider makes the App available as a web application.

§ 3 Registration and User Account

(1) Use of the App requires registration with a valid email address. Registration may also be carried out via a Google or Apple account.

(2) You are obligated to keep your login credentials confidential and not to share them with third parties.

(3) You must be at least 16 years of age to create an account.

§ 4 Free Use and Subscription

(1) The basic features of the App are available free of charge.

(2) Extended features are available through a paid subscription. The annual subscription currently costs EUR 55.00 per year. Payment is processed via Stripe.

(3) The subscription renews automatically for the respective subscription period unless cancelled before the end of the current period.

(4) Cancellation is possible at any time, effective at the end of the current billing period -- via account management within the App or by email to support@theosis-app.com.

§ 5 Right of Withdrawal

(1) As a consumer, you have a 14-day right of withdrawal from the date of conclusion of the contract.

(2) Withdrawal may be declared informally by email to support@theosis-app.com.

(3) By accessing digital content immediately upon completion of the subscription, you agree that the right of withdrawal expires once the provision of digital content has begun (in accordance with § 356(5) BGB / Article 16(m) of Directive 2011/83/EU).

§ 6 Community Guidelines

(1) Community contributions (notes, questions, answers) are visible to other users.

(3) The Provider reserves the right to remove contributions and to suspend user accounts in the event of repeated violations.

(4) Community contributions are automatically reviewed by an AI system for violations of these guidelines. Final decisions regarding removal or suspension are made by a human.

§ 7 Intellectual Property

(1) The content provided in the App (texts, translations, commentaries, images, audio) is subject to copyright or is available under open-source licenses (see source attributions within the App).

(2) User-generated content remains the property of the respective user. By posting content to the community, you grant the Provider a non-exclusive right of use for display within the App.

§ 8 Availability

(1) The Provider endeavors to ensure uninterrupted availability of the App. There is no entitlement to continuous availability.

(2) The Provider is entitled to temporarily restrict the App if this is necessary with regard to maintenance, security, or capacity constraints.

§ 9 Liability

(1) The Provider is liable without limitation in cases of intent and gross negligence.

(2) In cases of slight negligence, the Provider is liable only for breach of material contractual obligations (cardinal obligations), limited to the foreseeable, contract-typical damage.

(3) The App provides theological content for educational purposes. Pastoral counseling or medical advice is not offered.

§ 10 Account Deletion

(1) You may delete your account at any time via the settings within the App.

(2) Upon deletion, all personal data will be immediately and permanently removed. Recovery is not possible.

(3) Existing subscriptions should be cancelled before account deletion, as payment processing via Stripe operates independently.

§ 11 Amendments to the Terms of Service

(1) The Provider reserves the right to amend these Terms of Service. You will be informed of any changes by email or in-app notification.

(2) The amendments shall be deemed approved if you do not object within 4 weeks of receiving the notification.

§ 12 Applicable Law and Jurisdiction

(1) The law of the Republic of Estonia shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) For consumers, the mandatory consumer protection provisions of the state in which they have their habitual residence shall apply, insofar as they provide more favorable protection.

(3) The place of jurisdiction is Tallinn, Estonia, insofar as legally permissible.
